00 About these Terms
- Who we are: Stun is operated by REAPPS ("REAPPS", "we", "us").
- Agreement: By downloading, accessing, or using Stun, you agree to these Terms and our Privacy Policy.
- If you disagree: Do not use the Services.
- Definitions: "Services" includes the Stun app and related features. "User Content" includes photos and other materials you upload for private analysis and history.
01 Eligibility
- Minimum age: 13+ (16+ in EEA/UK).
- You represent you have legal capacity to accept the Terms.
02 Privacy
Use of the Services relies on the Privacy Policy (including photo-based analysis). By using Stun you acknowledge you have read and understand it.
03 Account and Sign in with Apple
You must sign in (currently via Apple). You are responsible for device/account access and all activity through your account.
04 Medical Disclaimer
The app does not and cannot offer medical advice; it provides suggestions for cosmetic purposes only. Recommendations are for informational purposes and are not substitutes for professional medical advice, diagnosis, or treatment. Verify ingredients and consider patch testing; discontinue use if adverse effects occur.
05 Automated recommendations & accuracy
No guarantee of accuracy, completeness, suitability, pricing, availability, or outcomes. Verify before purchasing or using products.
AI models: Stun may use internal AI models and/or third-party AI model providers (such as OpenAI or Google) to evaluate your inputs and generate recommendations. If you do not agree to this automated processing, do not use the Services.
06 Photos & private uploads
Private by default: Uploads are for your personal use inside Stun (history, progress tracking, and recommendations). Stun does not provide a public feed.
- Only you: Upload only photos/scans of yourself, unless you have explicit permission and it is lawful.
- No prohibited content: No sexual content/nudity, minors, hateful/violent content, illegal content, or content that infringes others' rights.
- Your responsibility: You are responsible for what you upload and represent you have the rights to do so.
06A Face scanning (TrueDepth/ARKit) & biometric information
- What we use: Some features use your device camera and Apple ARKit/TrueDepth sensors to create a face scan for cosmetic analysis and recommendations.
- Not for identification: We do not use face scans to identify you, perform Face ID authentication, or build an advertising profile.
- Storage: We do not store raw TrueDepth/ARKit face-mesh or point-cloud data on our servers. We may store derived outputs (e.g., skin attributes and recommendations) to provide history and improve results.
- Processing location: Depending on the feature, processing may occur on-device and/or in the cloud. See the Privacy Policy for details.
- Consent & legal rights: By enabling face-scan features you consent to this processing. Where local law requires additional consent or specific notices, we will present them in-app and you must accept to use the feature.
07 User Content license
You retain ownership of your photos/scans and other materials you upload ("User Content"). You grant REAPPS and our service providers a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and display User Content solely to operate, provide, secure, and improve the Services (including photo-based analysis, history/backups, and customer support).
No public posting: We do not display your User Content publicly unless you choose to share it.
Deletion: The license ends when you delete the relevant User Content or your account, except for limited retention required for legal compliance, dispute resolution, fraud/security, and secure backups (as described in the Privacy Policy).
08 Acceptable use
- No reverse engineering/decompiling (except where legally permitted).
- No scraping/automated access without permission.
- No interference with security or operations.
- No training a competing product where prohibited.
- No unlawful, fraudulent, or abusive use. Access may be suspended/terminated for violations.
09 Third-party services and links
Services may link to third parties or rely on providers (infrastructure, payments/subscriptions, and AI model providers such as OpenAI or Google). We do not control or endorse third-party content/products/services/policies. Their terms and privacy policies apply.
10 Subscriptions, free trials, billing, cancellation
- Subscriptions via Apple App Store; 3-day free trial may be offered.
- Auto-renews unless cancelled before renewal. Manage/cancel in Apple ID subscription settings.
- Refunds follow Apple's policies; we do not control Apple's decisions.
- Pricing/offerings may change with required notice.
10A EEA/UK consumer rights
- Mandatory rights: Nothing in these Terms limits rights you have as a consumer under applicable law.
- Digital services: If you are in the EEA/UK, you may have statutory rights related to digital services/content that cannot be excluded.
- Apple purchases: Billing, cancellation, and refunds for subscriptions purchased via Apple follow Apple's terms and policies, in addition to your mandatory rights.
11 Intellectual property
Services (excluding User Content) belong to REAPPS or licensors. You receive a limited, personal, non-transferable, non-sublicensable, revocable license for personal, non-commercial use subject to these Terms.
12 Feedback
If you share feedback/suggestions, we may use them without restriction or compensation.
13 Termination
You can stop using anytime and request deletion in-app (where available). We may suspend/terminate immediately for violations, security risk, or legal exposure. Relevant sections survive termination.
14 Disclaimers
SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, REAPPS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NO GUARANTEE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED.
15 Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, REAPPS IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS/REVENUE/DATA/GOODWILL. TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF AMOUNTS PAID IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100 (subject to jurisdiction limits).
16 Indemnification
You agree to indemnify, defend, and hold harmless REAPPS and affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your User Content, or your violation of the Terms or law.
17 Dispute resolution, arbitration, class action waiver
Informal first: Contact support@tinyworlds.app with a brief dispute description and requested relief.
Arbitration (US/most regions): Binding arbitration (AAA consumer rules or comparable). Remote format when reasonable. Small claims option if eligible.
Class action waiver: Disputes are individual only, to the maximum extent permitted by law.
EEA/UK carve-out: Mandatory consumer rights remain, including local court access where required. Mass arbitration: parties will coordinate fair handling if 25+ similar demands are filed.
18 Governing law
Governed by the laws of the Republic of Kosovo (conflict rules excluded). Arbitration agreement interpreted under applicable mandatory arbitration law (Federal Arbitration Act may apply in the U.S.).
19 App Store terms (Apple)
- Apple is not a party to these Terms and is not responsible for the Services.
- Apple has no obligation to provide maintenance/support.
- Claims relating to the App go to REAPPS (except where law requires Apple's involvement).
- Apple is a third-party beneficiary and may enforce these Terms.
20 Changes to these Terms
Terms may be updated. Material changes will be noticed (e.g., in-app). Continued use after changes become effective means you agree to the updates.
21 Service changes & availability
We may change, suspend, or discontinue any part of the Services at any time (including features, models, or availability). We may perform maintenance that causes downtime. Where required by law, we will provide notice.
22 Electronic communications
You agree that notices and communications may be provided electronically (e.g., in-app, via email, or via the App Store listing), and that electronic communications satisfy legal communication requirements where permitted.
23 Export controls & sanctions
You may not use the Services if you are (or are located) in a jurisdiction subject to comprehensive sanctions/embargoes, or if you are prohibited from receiving the Services under applicable export control or sanctions laws.
24 Assignment
You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law.
25 Severability & waiver
If any provision is held invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later.
26 Entire agreement
These Terms and the Privacy Policy are the entire agreement between you and REAPPS regarding the Services and supersede prior agreements on the subject.
